An Athens man has been indicted on several felony charges in connection with an incident last year in which he injured a roommate with a shotgun blast because he apparently was upset that the victim had disturbed his sleep.
A grand jury last Tuesday charged 52-year-old Kevin William Lowrie with aggravated assault, aggravated battery, possession of a firearm during the commission of a crime and resisting family violence criminal trespass, according to the indictment filed in Clarke County Superior Court.
The incident happened in June 2023 at a home on Sylvan Road that Lowrie shared with 58-year-old Kenneth Douglas Aguar.
A police report indicates that officers responded to the residence after a man called 911 to report that one of his roommates had shot another "on purpose."
As officers surrounded the residence, Lowrie, came out with his hands raised and was taken into custody without incident, police said.
According to the report, Lowrie explained that he had been trying to sleep but Aguar was banging the wall with a hammer and calling him profane names and challenging Lowrie to “come out and face me (redacted) boy.”
“Lowrie told me he had enough” and fired one round from a 12-gauge shotgun through Aguar’s door, then heard the victim screaming that his arm was broken,” an officer wrote in the report.
Lowrie was arrested for aggravated assault, possession of a firearm during the commission of a felony, and criminal damage to property.
A Clarke County Superior Court grand jury last week indicted him for those offenses, and added the charge of aggravated battery for rendering the arm and shoulder of the victim “useless” and requiring surgery.
Lowrie had been freed on bail from custody, and he is scheduled to be arraigned on the indictment on Sept. 17.
According to this article, It sounds like Aguar definitely had it coming and got more than he asked for!
