A Clarke County grand jury last week indicted a 33-year-old Eatonton man for the alleged rape of a University of Georgia student over two years ago.
Ricardo Javier Hernandez allegedly had non-consensual intercourse with the victim on April 17, 2022 after entering her bedroom while she was asleep at the Arches on the Lake student housing complex, according to court documents.
The victim had previously told Hernandez that she did not want to have a sexual relationship with him, court records indicate.
In a September order denying bail, Western Judicial Circuit Chief Judge Lisa Lott noted that Hernandez had surrendered to authorities in August of this year after having been aware of the student’s allegations since the day of the alleged incident.
Bail was denied due to U.S. Immigration and Customs Enforcement having placed a hold on Hernandez’s release from the county jail.
The judge also noted in her order that Hernandez had lived with his parents at his Eatonton address since he was seven years old, and there had been no indication that he had fled the court’s jurisdiction.
Hernandez is scheduled to be arraigned on the indictment December 3.
